We offer certain services that do not require you to register for an account or provide any personal information to us, such as Open Source Document Search. In order to provide our full range of services, we may collect the following types of information:

Information you provide - When you sign up for a Lookout Point account or other service or promotion that requires registration, we may ask you for personal information (such as your name, email address and an account password). In the event that you are asked to give credit card or other payment account information, this will be part of a third party service, such as PayPal, where the information will be maintained by them according to their agreements with you. We do not see or maintain any of your financial information.

Log information - When you use our services, our servers automatically record information that your browser sends whenever you visit a website. These server logs may include information such as your web request, Internet Protocol address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser.

User communications - When you send email or other communication to us, we may retain those communications in order to process your inquiries, respond to your requests and improve our services.

Affiliated sites - In the event that we might offer some of our services in connection with other web sites, personal information that you provide to those sites may be sent to us in order to deliver the service. We process such information in accordance with this Policy. The affiliated sites may have different privacy practices and we encourage you to read their privacy policies.

Links - Lookout Point may present links in a format that enables us to keep track of whether these links have been followed. We use this information to improve the quality of our search technology, customized content and advertising. For more information about links and redirected URLs, please see our FAQ below.

Other sites - This Privacy Policy applies to web sites and services that are owned and operated as part of the Lookout Point information service. We do not exercise control over external sites displayed as search results or links from within our various services. These other sites may place their own cookies or other files on your computer, collect data or solicit personal information from you. Lookout Point only processes personal information for the purposes described in this Privacy Policy. In addition to the above, such purposes may include: providing our products and services to users, including the display of customized content and advertising; auditing, research and analysis in order to maintain, protect and improve our services; ensuring the technical functioning of our network; and developing new services.

Lookout Point processes personal information on our servers in the United States of America and perhaps in other countries. We may process personal information to provide our own services. In some cases, we may process personal information on behalf of and according to the instructions of a third party, such as our advertising partners.

Choices for personal information

When you sign up for a service that requires registration, we ask you to provide personal information. If we wished to use this information in a manner different than the purpose for which it was collected, then we would ask for your consent prior to such use.

If we propose to use personal information for any purposes other than those described in this Policy and/or in any specific service notices, we will offer you an effective way to opt out of the use of personal information for those other purposes. We will not collect or use sensitive information for purposes other than those described in this Policy and/or in any specific service notices, unless we have obtained your prior consent.

You can decline to submit personal information to any of our services, in which case Lookout Point may not be able to provide those services to you.

Information sharing

Lookout Point would only share personal information with other companies or individuals outside of it in limited circumstances where we have your consent. We require opt-in consent for the sharing of any sensitive personal information. We only provide such information to our subsidiaries, affiliated companies or other trusted businesses or persons for the purpose of processing personal information on our behalf. We require that these parties agree to process such information based on our instructions and in compliance with this Policy and any other appropriate confidentiality and security measures. We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms of Service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against imminent harm to the rights, property or safety of Lookout Point, its users or the public as required or permitted by law. If the Lookout Point information service becomes involved in a merger, acquisition, or any form of sale of some or all of its assets, we would provide notice before personal information is transferred and becomes subject to a different privacy policy.

We may share with third parties certain pieces of aggregated, non-personal information, such as the number of users who searched for a particular term, for example, or how many users clicked on a particular advertisement. Such information does not identify you individually.

Please contact us at the address below for any additional questions about the management or use of personal data.

Information Security

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data.

We restrict access to personal information to Lookout Point employees, contractors and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

Data integrity

Lookout Point processes personal information only for the purposes for which it was collected and in accordance with this Policy or any applicable service-specific privacy notice. We review our data collection, storage and processing practices to ensure that we only collect, store and process the personal information needed to provide or improve our services. We take reasonable steps to ensure that the personal information we process is accurate, complete, and current, but we depend on our users to update or correct their personal information whenever necessary.

Accessing and updating personal information

When you use Lookout Point services, we make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort. Some of our services have different procedures to access, correct or delete users' personal information. We provide the details for these procedures in the specific privacy notices or FAQs for these services.

Changes to this policy

Please note that this Privacy Policy may change from time to time. We will not reduce your rights under this Policy without your explicit consent, and we expect most such changes will be minor. Regardless, we will post any Policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of Policy changes). Each version of this Policy will be identified at the top of the page by its effective date, and we will also keep any prior versions of this Privacy Policy in an archive for your review.

Privacy FAQ (Frequently Asked Questions)

What is personal information?

"Personal information" is information that you provide to us which personally identifies you, such as your name, email address or billing information, or other data which can be reasonably linked to such information by Lookout Point.

What is a Lookout Point Account?

You may access some of our services by signing up for a Lookout Point Account and providing us with some personal information (typically your name, email address and a password). This account information will be used to authenticate you when you access Lookout Point services and protect your account from unauthorized access by others. We may share personal information among our various services in order to customize content and enhance our services for you. No account information is shared with anyone other than Lookout Point except as specified in this Privacy Policy or with your consent. You can edit or terminate your account at any time by so requesting.

What is a cookie?

A "cookie" is a small file containing a string of characters that is sent to your computer when you visit a website. When you visit the website again, the cookie allows that site to recognize your browser. Cookies may store user preferences and other information. You can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some website features or services may not function properly without cookies.

What are server logs?

Like most Web sites, our servers automatically record the page requests made when users visit our sites. These "server logs" typically include your web request, Internet Protocol address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser.

Here is an example of a typical log entry for a Google search where the search is for "cars", followed by a breakdown of its parts:

123.45.67.89 - 25/Mar/2003 10:15:32 - http://www.google.com/search?q=cars - Firefox 1.0.7; Windows NT 5.1 - 740674ce2123e969

123.45.67.89 is the Internet Protocol address assigned to the user by the user's ISP; depending on the user's service, a different address may be assigned to the user by their service provider each time they connect to the Internet; 25/Mar/2003 10:15:32 is the date and time of the query; http://www.google.com/search?q=cars is the requested URL, including the search query; Firefox 1.0.7; Windows NT 5.1 is the browser and operating system being used; and 740674ce2123a969 is the unique cookie ID assigned to this particular computer the first time it visited Google. (Cookies can be deleted by users. If the user has deleted the cookie from the computer since the last time he or she visited the site, then it will be the unique cookie ID assigned to the user the next time he or she visits that site from that particular computer).

What information does Lookout Point receive if I click on a link displayed on Lookout Point?

When you click on a link displayed on Lookout Point, the fact that you clicked on the link may be sent to Lookout Point. In this way, Lookout Point is able to record information about how you use our site and services.

We use this information to improve the quality of our services and for other business purposes. For example, Lookout Point can use this information to determine how often users are satisfied with the first result of a query and how often they proceed to later results. Similarly, Lookout Point can use this information to determine how many times an advertisement is clicked in order to calculate how much the advertiser should be charged.

What is sensitive information?

"Sensitive personal information" includes information we know to be related to confidential medical information, racial or ethnic origins, political or religious beliefs or sexuality and tied to personal information.

What is aggregated non-personal information?

"Aggregate non-personal information" is information that is recorded about users and collected into groups so that it no longer reflects or references an individually identifiable user.

URLs and embedded information

Some Lookout Point services might send the uniform resource locators ("URLs") of web pages that you request to Lookout Point. In this case Lookout Point would receive and store the URL sent by the web sites you visit, including any personal information inserted into those URLs by the web site operator.

For example, some other Web services (such as Google Toolbar) enable you to opt-in or opt-out of sending URLs to Google, while for others (such as Google Web Accelerator) the sending of URLs to Google is intrinsic to the service. When you sign up for any such service, you will be informed clearly that the service sends URLs to Google, and whether and how you can opt-in or opt-out. As a general rule, Lookout Point does not involve itself in this kind of passing of embedded information except as relates to monitoring search results internally towards the improving of our services to you, and where it is needed to provide access to other restricted Lookout Point services without the need to again log in to that service.

When you submit information to a web page (such as a user login ID or registration information), the operator of that web site may "embed" that information - including personal information - into its URL (typically, after a question mark ("?" ) in the URL). When the URL is transmitted to Lookout Point, our servers automatically store the URL, including any personal information that has been embedded after the question mark. Lookout Point does not exercise any control over these web sites or whether they embed personal information into URLs.

What protections do I have against intrusions by the government into my use of Lookout Point services?

Lookout Point does comply with valid legal process, such as search warrants, court orders, or subpoenas seeking personal information. These same processes apply to all law-abiding companies. As has always been the case, the primary protections you have against intrusions by the government are the laws that apply to where you live.
